Selarati LLC Participant Liability Waiver, Assumption of Risk & Release of Claims

1. Parties & Acknowledgment

This Liability Waiver and Release of Claims (“Agreement”) is entered into between the undersigned participant (“Participant”) and Selarati LLC, a New Hampshire limited liability company, including but not limited to its owner Priscilla Kim Ong, employees, representatives, agents, contractors, local guides, drivers, accommodation providers, vendors, and partners (collectively “Selarati”).

By signing this Agreement, Participant acknowledges that they have read, understood, and voluntarily agree to all terms herein and in the accompanying Selarati Terms & Conditions.

2. Voluntary Participation & Assumption of Risk & Responsibility

Participant voluntarily elects to participate in AKKHE and understands that all travel and group activities involve inherent risk. Participant accepts full personal responsibility for their health, safety, and conduct during participation in all trip-related activities.

2.1. Illegal Substances & Compliance with Laws

The Participant agrees to comply with all local laws and regulations of Cambodia throughout the duration of AKKHE. This includes, but is not limited to, refraining from the use, possession, purchase, distribution, or consumption of any illegal drugs or controlled substances under Cambodian law.

The Participant acknowledges that drug laws in Cambodia are strict, and violations may result in severe legal consequences, including arrest, fines, detention, or imprisonment.

The Participant further agrees to conduct themselves in a lawful, respectful, and responsible manner at all times.

Selarati LLC, its hosts, coordinators, contractors, and affiliates assume no responsibility or liability for any legal consequences resulting from a Participant’s failure to comply with local laws.

The Participant understands that Selarati LLC does not condone or permit any illegal activity during AKKHE, and any illegal activity, violation of local laws, or behavior that jeopardizes the safety, well-being, or reputation of the group, local partners, or Selarati LLC may result in immediate removal from AKKHE, at the sole discretion of Selarati LLC, without refund or compensation.

2.2. Alcohol Use & Personal Responsibility

Alcohol may be available at certain meals or social settings during AKKHE; however, participation in alcohol consumption is entirely optional and never expected.

Participants who choose to consume alcohol agree to do so responsibly and in accordance with local laws. Each Participant is solely responsible for their own alcohol consumption and any resulting consequences, including injury, illness, impaired judgment, accidents, or interactions with others. Selarati LLC, its hosts, coordinators, contractors, and affiliates assume no liability related to alcohol use.

Selarati LLC reserves the right to intervene or ask a Participant to limit or stop alcohol consumption if behavior becomes unsafe, disruptive, or negatively impacts the group. Continued unsafe behavior may result in removal from AKKHE at the Participant’s own expense, without refund.

Participants agree to indemnify and hold harmless Selarati LLC, its hosts, coordinators, contractors, and affiliates from any claims, damages, losses, or expenses arising from their voluntary consumption of alcohol.

3. Nature of Activities & Inherent Risks

AKKHE may include, but is not limited to:

  • Travel by vehicle, motorbike, tuktuk, boat, or bicycle;

  • Walking or hiking on uneven terrain;

  • Visiting rural areas, memorials, or historical sites;

  • Participation in group discussions or reflective activities;

  • Exposure to local foods, weather, insects, or environmental conditions.

  • Participant acknowledges these activities carry risks including injury, illness, emotional distress, theft, delays, or property loss, and voluntarily assumes all such risks, whether foreseen or unforeseen.

4. Independent Third Parties

Selarati partners with independent third-party providers (e.g., hotels, transportation, guides, local operators). These parties are not employees or agents of Selarati, and Selarati is not responsible or liable for their acts, errors, or omissions. Participant releases Selarati from liability related to services provided by third parties.

5. Health, Fitness & Medical Authorization

Participant certifies they are physically and mentally fit to participate and have disclosed any conditions or limitations.

Participant authorizes Selarati or its representatives to obtain emergency medical treatment if necessary and agrees to be fully responsible for all related costs.

Selarati makes no guarantees regarding medical care quality or availability.

6. Emotional & Psychological Wellbeing

Participant understands that the trip may include visits to sites or discussions that evoke emotional or psychological responses (e.g., memorials, trauma-related topics, identity reflection). Participant voluntarily assumes all risks of emotional distress and agrees that Selarati is not liable for resulting discomfort, stress, or trauma.

Selarati does not provide therapy or psychological counseling, and participation in reflective activities is voluntary.

7. Insurance

Selarati requires that participants carry travel medical insurance for international travel to Cambodia during the trip dates and strongly recommends comprehensive travel insurance covering emergencies, evacuation, and trip interruption/cancellation.

Failure to carry insurance is at the participant’s own risk.

8. Release & Waiver of Claims

To the fullest extent permitted by law, Participant hereby releases, waives, and forever discharges Selarati and its representatives from any and all claims, causes of action, damages, or liabilities arising out of or related to participation in AKKHE — including those resulting from ordinary negligence.

This includes, but is not limited to:

  • Personal injury, illness, or death;

  • Emotional or psychological distress;

  • Property loss or damage;

  • Delay, cancellation, or disruption;

  • Actions or omissions of other participants or third parties.

This release extends to all future Selarati programs unless revoked in writing.

9. Indemnification

Participant agrees to indemnify and hold harmless Selarati and its representatives from any claims, losses, or damages (including legal fees) arising out of Participant’s acts, omissions, or breach of this Agreement.

9.1. Participant Financial Responsibility

Participant acknowledges and agrees that they are fully and personally responsible for any and all costs, damages, losses, liabilities, or expenses they cause during or in connection with the trip, whether intentional, negligent, or accidental.

This includes, but is not limited to:

  • Damage to or loss of hotel property, accommodations, vehicles, boats, bicycles, or equipment;

  • Cleaning, repair, or replacement costs resulting from misuse, negligence, or accidents;

  • Charges for room service, minibar, laundry, phone calls, spa services, meals, beverages, or any other personal expenses incurred at hotels, restaurants, or venues;

  • Additional transportation, rebooking, or service costs resulting from Participant’s actions, failure to follow schedules, or disregard of instructions;

  • Fines, legal fees, citations, or penalties resulting from Participant’s behavior or actions contrary to local laws or regulations;

  • Medical or emergency expenses not covered by insurance;

  • Any additional charges billed to Selarati by third-party providers as a result of Participant’s conduct, delay, or default.

Participant agrees to settle any such charges directly with the third-party provider at the time they are incurred whenever possible.

If Selarati LLC or its representatives are billed, charged, or otherwise held financially responsible for any of the above, Participant agrees to reimburse Selarati in full immediately upon notice. Selarati reserves the right to:

  1. Deduct or charge such amounts to the same credit or debit card used for trip payments; and/or

  2. Issue an invoice payable upon receipt for reimbursement of said charges.

Participant acknowledges that Selarati LLC acts only as a coordinator and intermediary with third-party providers and is not responsible for disputes between the Participant and such providers. Any disputes over charges or damages must be resolved directly with the service provider, and do not relieve Participant of their obligation to reimburse Selarati for any costs initially billed to Selarati.

Participant further agrees that:

  • All determinations by Selarati regarding damage, costs, or responsibility shall be final and binding, based on documentation or statements from hotels, vendors, or local partners.

  • Failure to reimburse such costs may result in cancellation of participation, denial of future trip eligibility, and/or referral to collections or legal action to recover damages and associated fees.

In shared accommodations, each Participant remains individually liable for any expenses, damages, or charges they personally incur. Selarati is not responsible for mediating or covering costs resulting from roommate disputes or shared expenses.

Participant agrees that this obligation for reimbursement or direct payment survives completion or cancellation of the trip and remains enforceable under the governing law of this Agreement.

10. Conduct & Removal

Selarati reserves the right to remove or refuse service to any participant whose behavior is unsafe, unlawful, or disruptive to the group. Removal is at the participant’s expense and without refund.

11. Force Majeure & Trip Modifications

Participant acknowledges that trip modifications, delays, or cancellations may occur due to circumstances beyond Selarati’s control (e.g., weather, government actions, unrest, illness, or natural disasters).

Selarati’s refund, credit, and cancellation policies are defined in the Terms & Conditions, which Participant affirms they have read and accepted.

12. Limitation of Liability

Selarati’s total liability shall not exceed the amount paid directly by Participant for the trip.

Selarati shall not be liable for indirect, consequential, incidental, or punitive damages of any kind.

13. Media Release

Participant acknowledges that Selarati LLC and its representatives may photograph, film, and otherwise record portions of AKKHE for documentation, education, and promotional use.

By signing this Agreement, Participant grants Selarati a perpetual, worldwide, royalty-free license to use their likeness, image, name, and voice in any media format for marketing, archival, or educational purposes.

Participant understands and agrees that:

  • Selarati cannot exclude individuals from group or wide-angle scenes where participants appear incidentally.

  • Participants who wish to opt out of individually featured media (e.g., solo photos, interviews, close-ups) must notify Selarati in writing prior to the trip at contact@selarati.com.

  • Selarati will make reasonable efforts to accommodate opt-out requests for future publications, but cannot remove previously captured or shared content.

Participant waives all rights to inspect or approve materials containing their image and releases Selarati from all claims related to media use, including invasion of privacy or misappropriation of likeness.

14. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of New Hampshire, USA.

Any dispute shall be resolved by binding arbitration in New Hampshire, under the American Arbitration Association rules.

Claims may only be brought individually, not as part of a class or collective action.

15. Severability & Entire Agreement

If any portion of this Agreement is found invalid or unenforceable, the remaining provisions remain in effect.

This document, together with the Selarati Terms & Conditions, constitutes the entire understanding between Participant and Selarati.

16. Electronic Signature

By checking the acknowledgment box and typing their full legal name on the official Selarati form, Participant agrees that this constitutes their electronic signature, legally binding under the U.S. E-Sign Act.
